Use of the Service

PhotoPrompt provides users with a platform to convert images into AI prompts and access comprehensive prompt libraries for various AI image generation platforms. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.

2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Image-to-Prompt Conversion and Content

1. Image Submission: By submitting images for prompt conversion, you represent that you have the right to use and share this content with us.

2. Conversion Accuracy: While our AI technology achieves 85%+ accuracy in prompt generation, we cannot guarantee perfect results in all cases. Processing time is typically under 3 seconds.

3. Usage Limits: Different subscription plans include varying limits on conversions and features:

   • Free Tier: 10 image-to-prompt conversions per day
   • Pro Tier ($9.99/month): Unlimited conversions, premium prompt library, priority processing
   • Business Tier ($49.99/month): Everything in Pro, plus API access (10,000 calls/month), custom style guides, team collaboration

Content and Intellectual Property Rights

All content provided through PhotoPrompt, including but not limited to the AI models, prompt generation technology, user interface, prompt libraries, and documentation, is protected under copyright law. The copyright owner of PhotoPrompt is PhotoPrompt.

• You acknowledge that you do not own the underlying technology or intellectual property that makes up the PhotoPrompt service, and you agree to respect the intellectual property rights of PhotoPrompt and any third parties.
• You retain ownership of the original images you submit for conversion.
• Generated prompts are provided under license according to your subscription plan.
• You may use generated prompts for commercial purposes according to your plan's terms.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using PhotoPrompt:

• Unauthorized access to or distribution of our proprietary algorithms and technology
• Reselling or redistributing PhotoPrompt services without authorization
• Interfering with or disrupting the security or performance of the service
• Using the service for any illegal or unauthorized purpose
• Attempting to bypass any security features or usage limits of the service
• Uploading content that infringes on others' intellectual property rights
• Attempting to reverse-engineer our AI models or prompt generation algorithms
• Using automated scripts or bots to access the service without permission
• Sharing account credentials or allowing unauthorized access to your account

API Usage Terms

For Business Tier subscribers with API access:

1. Rate Limits: API usage is limited to 10,000 calls per month
2. Authentication: You must secure your API keys and not share them publicly
3. Commercial Use: API access may be used for commercial applications
4. Attribution: When using our API in public-facing applications, attribution to PhotoPrompt is appreciated but not required

Privacy and Data Collection

PhotoPrompt collects the following types of data:

• Account Information: Information you provide when creating an account

Pricing and Payments

• Payment processing is handled securely through Stripe
• Subscription renewals are automatic unless cancelled

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Disclaimer of Warranties
